Siw. 1. Be It enfatedi by the Gnerail Assembly qf th iState  limey, &e.
of NAorth-aurolina, and it is hereby cnacted iby 'tei author,'
qf the wamne, That if aly person or persons shall hereafter
f'll any tiiber in the N ortheast br'anch of the Cape Fear
rivor in the county of D uplin, at any point or place on said
river froim the up >r Korncgay's bridge, near the mouth of
Rattlesnake croek, down t1he same to the mouth of Goshen
swaip, or otherwise obstruct the same, the person or por-
sons so offending shall he deiIIed guilty of a Imisdkimeanior,
and may be iulicted in the county or superior courts of said
county, and, upon conviction, shall be fined, at the discre-
tion of the court, a sum not exceeding fifty dollars.
Sia. 2. Be it fiurther enacted, Thatif any negro slave he siovos unmhnd-
convicted of felling timber into, or otherwise obstructing ''*
said river in the county aforesaid, before any justice of' the
peace of said county, 1rovided his master or miistress, over-
seer or enmployer shall have had five days' notice in writing
of the chargo against him, previous to his trial, he shall, for
each and overy offence, he punished at the discretion of the
justice of the peace: Provided, tile sanmo shall not exceed
thirty-nino lasles on his bare back, whihl punishint shall
be inflicted by the shiifiiP, conistalle or such other ofliecer of
said county as mIlay have arrested said slave. [H Iattiled the
