the same, That heroafter it shall be the duty of the sheriff
of each county to-hiy before the Grand Jury of his county,
at each court, as soon-as the said Grand Jury shall be as-
scmbled, a list of all persons who may have obtained license
to retail spirituous liquors by the small mouAsui c during the
timel he may have been sheriff. not exceeding two years pro-
vious to said court. And any sheriff, failing to perform the
duty aforesaid, shall forfeit and pay to the State the sum of
ten dollars, to be sued for and recovered for the State by the
erosecuting oflicer of said'court.

ing shall I,- subject to indictmeit, andl. on conviction, shall be
fined or ins miSoned at the discicrt ion of the court: Provided.
