Sne. X. Ie itfurthei enact ed; That if any ri'ciseer appointed under
this act shall fail or retuse to perform ank of the duties reqtired of
him by said act, he. shall, for eery such faihire or refusal, f6rfeit and
pay the sum of one hundred dollars; to be recovered by warrant be.
foro any jultico of the peace, o:ne half to the use of the poof of Stokes
c6unty, and the other half to tl. person vho will sne-for the same.
ISBc. XI. B.l it further dndetedi That. the 6verseers appoint-.
ed under 'this act shlfal continue in-oflice for one year;, and it shall
be the duty 6f the court thereafter to. appoint other overseers, when-
ever, in the opinion of said court, it shall be necessary, in order to
keep said creek and its said btanches in the oider 'required by this
act.
S, . XII. Ie it further enacted, That if any person or persons
shall hereaftercut or throwv or by any means whateveri cause to be cut
or thrown, any timber, brush or any other filth or rubbish into said
creek or branch or branches, within anyof the districts which shall
or may be laid off by said court,,eaph and every person so offending
shall, for each and every shah'oiltnce, for(eit'and paythe sumof forty
dollarsi to.be recovered by warrant before any Justice of Peace, to
the use of the person who shall sun for (lie same.
Sac. XIII. And be it further enacted, That this act shall be ill
force fro'nt and after its ratification.
