pealing from the sentence of said Court, upon his or her ma-
Icing it appear to the satisfaction of the Court that lie or she
is unable to give security for said appeal, it shall be the dii-
ty of the Court by whom said judgment of death shall be
pronounced, to allow an appeal to the Supreme Court with-
out requiring the defendant to give security for the same.
Sxnc. 2.  Be it further enacted, That all laws and
clauses of laws, which are or may be inconsistent with the pe ig
foregoing provisions of this act, be, and the same are here-
by repealed.
SEc. 3. Be it fukrer enacted, That this act shall be
in force from and after its ratification.

CHAP. III.
An Act regulating Appeals.
Be it enacted by the General Assembly of the
,S'tate of North Carolina, and it is hereby enacted by the
authority of the same, That for all offences cognizable un-
der the 41st section of chapter  111, Revised Statutes, the
master of the slave ho allowed an appeal from the decision
ofthe Justice to the Countxy Court, undersuch rules, regula-
tions and restrictions as are now provided for in criminal
cases.
