CHAPTER CLXIV.

seers of roads in the county of An on.
le it enacted I'y the General 4sserbly of lhe Slate of Nortlh (arolinq,
and it is hereby enacted hy- the authority of the same, That ail overseers
of roads who are, or shall be appointed agrceabletio, the provisions of
the 'above recited act, and who shall fail to return their orders at the expira-
tion of the year for which they are, or shall be appointed, and the County
Court thereby fails to make another or other appointments, the overseor or
oversebrs in such case retaining his or their order or orders shall,'to all in.
tents and purposes,,be considered overseer or overstiers fnr' twelve months
longer, and until their orders be returned or appointments made as con-
teinplated by said act, except in case of death or removal; any thing con-
tained in said act to the contrary notwithstanding.
CHAPTER CLXV.
An act to authorise Jeremiah Ingram, of the county of Anbon, tn erect a gate across the road
lea'in from Wadesborough to Stantibeck's ferry on t'eette river.
.Be it enacted by the General .1sscinbly of the State of .North Carol~na,
(nd it is hereby enacted by the authority of the same, That Jeremiah Ingram,
of the county of Anson, be, and he is hereby authorisedto erect a gate on
his own land, across the road leadin  from 'Wadesborough to Stanback's
ferry on Peedee river, at or near his blacksmith's shop, under the siame
rules, regulations and restrictions as are provided by law in such cases.
CHAPTER CLXVI.
An act to appoilit comnuisaioners for the town of Balth.
Be it enacted by the General dssenibly of the State of North Ca'olina,
and it is hereby enacted by the authority of the same, That on the first
Monday in February next, and in each an'd every year thereafter, there
shall be an election held in the town of Bath, for the purpose of choosing
five fit and proper persons to act as commissioners of said town; and should
any person so elected die, remove or become unable to perform the several
duties which may devole upon him, then and in such case the remaining coin-
missionersare auithorised anti empowered to appoint another in his place.
If. Be it further enacted, That should any person so elected or appointed
refuse or nglect to act as a commissioner of said town, such person so
neglecting or refusing to act shall forfeit anti pay the sum of twenty dol-
lars, to be recovered before any jurisdiction having cognizance thereof, one
half' to the use of.the town, and the other half to the use of the person
suing for the same.
III. Be it further enacted, That the election for commissioners shall be
conducted under the same rules, regulations and restrictions and penalties
its are now observed in elections of a similar kind.       ..
IV. Be it farther enacted, That all laws and clauses of imqws, coming
within purview and meaning of this act, be, and the same are hereby re-
pealed.
V. Be it further enacted, That this act shall be in force from and after
the ratification thereof.
