Be it further enacted, That it shall be the duty of the Governor, whenever eight companies, organized by this act, and located in contiguous counties, shall make through their respective commands a written applica- tionto be formed into a regiment,. to order an immediate election to be held for one, colonel, one lieutenant-colonel, and one major, of said regiment, and no person shall be entitled to vote for said officers who is not a regularly enrolled member of one of said companies. SEC. 6. Be it further enacted, That this act shall take effect froi its passage. Approved November 3, 1865. CHAPTER XXIII. AN ACT to punish certain offences therein named, and for other purposes. SECTION I. Be it eOacted by the Legislatare of the, State of Mississippi, Tbat no freetinan, free negro or mulatto, not in the military ser- vice of the United States G1-overnment, and not licensed so to do1) by the board of police of his or her county, shail keep or carry tire-arms of any kind, or any ammunition, dirk or bowie laife, and on conviction thereof, in the county court, shall be punished by fine, not exceeding ten dollars, anld pay the costs of such pro- ceedings, and all such arns or ammunition shall be forfeited to the informer, and it shall be the duty of every civil and military officer to arrest any freedman, free negro or mulatto found with any such arms or anuunition, and cause him or her to be committed for trial in default of bail. SEc. 2. Be it further enacted, That any Penalty for freedmnani, free negro or mulatto, committing diaturbances riota, routes, affrays, trespasses, malicious mis- fte ee 12 165.
