State of Mississippi, That in all cases wherein any
papers have been filed in ahy cause in the Circuit
Court of Tallahatchie county, either notes, bills,
accounts or other evidences of indebtedness, or
receipts or any other papers, or writing or plead-
ings, and the same have heretofore been, or shall
hereafter be lost, mislaid or destroyed, upon proof
of the fact of such loss or distruction, and the
contents in substance of the same, to the satishc-
tion of the Court, the Court may order such pa-
pers substituted, and proceed with the case as
though the original papers were on file; Provided,
that the parties shall have the same rights, privi-
leges and benefits of all the rules of defence and
pleading as in other cases.
SEC. 2. Be it further enacted, That the proof
of the substance of any such papers shall be ad-
dressed to the Court,and determined by the Court
upon the proof adduced ; Provided, that the judg-
ment of the Court may, as in other cases be re-
versed by the High Court of Errors and Appeals
upon bill of exceptions taken as now provided by
law.
SEc. 3. Be it further enacted, That this act
shall take effect and be inl force from and after its
passage.

CHAPTER XCIX.
AN ACT to amend an act entitled an act to establish and
incorporate the Town of Yazoo City, approved March 3d,
1846.
SECTION 1. Be it enacted by the Legislature of
the State of Mississippi, That hereafter, that when-
ever any slave, free negro or mulatto, shall be con-
victed before the Mayor of said town of any of-
fence against the charter and ordinances of said
town, such slave, free negro or mulatto, so offend-
ing, shall be punished only by any number of
stripes not exceeding thirty-nine, to be inflicted by
