CHAPTER 42.
AN ACT to regulate the granting of Licenses to retail Vinots and
Spirtous Liquors.
SEc. 1. .e it Cnacted by t1he Lcgist'Gure of the State No license
of Mississippi, That it shall not be lawful for the granted
Board of Police of any county, or the corporate titonof-
authorities of any city or town, in this State, to grant gal voters.
license to retail vmous or spiritous liquors to any
person or persons applying for the same, unless the
person or persons applying for the same shall first
produce a petition for the issuance of such a license,
signed by a majority of the legal voters resident in
the Police district where such liquors are to be sold;
and if such liquors are to be sold within the limits of
an incorporated town, then by a majority of the le-
gal voters resident therein.
SEe. 2. Be it further enacted; That the said Boards Eond.
of Police,before issuing any such license, shall require
and take bond from the applicant, with two or more
sureties, to be approved by said board. payable to the
president thereof, and his successors in office, in the
penalty of five hundred dollars; conditioned that the
person to whom such license shall be'granted, shall
keep a quiet, peaceable, orderly house for retailinr
spiritous liquors in said district, city, or town (as
the case may be,) and shall not permitor allow gam-
ing to be carried on in such house, or on the promises
thorounto belonging, and shall not retdil or otherwise
dispcose apiritous liquors to slaves or Indians;
and whenever at any time such bond shall bccome
forfeited, the same shall be put in suit and prosecu-
ted, and the amount recovered, shall enure to the
benefit of the common school fund of the county;
and upon a violation of the conditions of said bond,
the said board of Police shall have full power, atall
times, to revoke and annul such license so granted,
if said Board shall be of opinion, after causing the
person having any such license, to appear before
said Board, and due investigation had thereon, that
the conditions have in anywise been forfeited; and up-
on such license being so revoked, the amount of

to run out from such revocation at the rate paid for
sai d license when theywere issued, shall be return-
ed to the person or persons whose license issued has
