CHAPTER 9.
AN ACT to incorporate the Mississippi and Tennessee Rad-
road Company.
Sf.cTIoN 1. Be it enacted by the Legislature of th
State of flississippi, That J. C. N. Robertson, Henry.
Dockery, F. M. White, David S. White, J. G. Brody,
- Gillespie, R. A. Parker, Fletcher Lane, and R.
Ferguson, with such other persons as shall associ-
ate with them for that purpose, are constituted a
body politic and corporate, by the name of the
Mississippi and Tennessee Railroad Company; and
by that name to sue and be sued, plead and be im-
May hane pleaded, in any court of this State; to make and
a common have a common seal, and the same to alter, break,
seal.   or renew at pleasure.
SEc. 2. Be 'it ferlther enacted, That said corpora-
tion shall be, and are hereby, vested with the rights
and authority to construct a railroad, with double
strct road or single track, commencing on the northern boun-
dary line of this State, at such point as may be
deemed most eligible by the corporation, and run
through such portions of the counties of DeSoto,
Panola, Yallobusha, and Tallahatchie, and connect
with the Mississippi Central Railroad at such point
as they may elect; and in the event that the Mis-
sissippi Central Railroad Company shall not com-
plete their road to Canton, in Madison county,
then the Mississippi and Tennessee Railroad Com-
pany are hereby authorized to continue their road
to the above named place, by such route as, after
due examination and survey, shall be considered
the most eligible, such railroad way or privilege
to be lifty feet wide on both sides from the centre
of the track of the railroad, and to transport, take,
and carry, persons and property, of every descrip-
tion whatsoever, upon the same, by the power of
steam, of animals, or of any other mechanical pow-
er, or a combination of them, which said company
may choose to employ; and the guage or width ot
the track of said road shall be five feet.
Suc. 3. Be it further enacted, That the capital
