CHAPTER 231.
AN ACT to repeal a,! act entitled an act to.incorporate the Deer
Creek Navigation Company, approved Match 4, 1848, and for other
purposes.
SECTION 1. Be it enacted by the Legislature of the
Statc of Alississippi, That the above recited act be,
and the same is hereby repealed.
SEC. 2. Be it further enacted, That a board of Incorpora-
commissioners, for the removal of obstructions in and tion.
for the improvement of the navigation of Deer Creek,
Rolling Fork, and Lower Black Bayou, be, and the
same is hereby constituted; said board shall consist
of three citizens of the county of Issaquena, and
three citizens of the county of Washington, all resi-
dents on the banks of said creek, and until after the
appointment of their successors, as hereinafter pro-
vided; the said board shall consist of the following
named persons, to wit: D. 0. Williams, Malachi
Bradford, Mordecai Powell, Newitt H. Vick, IW. F.
Smith, and James T. Rucks, any four of whom shall
be a quorum for the transaction of business.
SEC. 3. Be it further enacted. That the said
board shall at their first meeting elect, from their own
body, a president and secretary, and shall keep a re-
cord of their proceedings.
SEC. 4. Be it further enacted, That said board
of commissioners shall have power and authority to
contract for and supervise the removal of all obstruc-
tions to the convenient navigation of said creek, fork
and bayou ; but the said board shall not, nor shall
any membdr thereof, be interested in any contract
made by said board, or receive any compensation for
his services as a member or officer thereof.
SEC. 5. Be it further enacted, That the Board Tax to be
of Police, of the counties of Issaquena and Wash- levied,
ington, shall respectively cause to be levied, for the
year 1850, and annually thereafter, such tax on all
lands in their respective counties lying on or within
one mile of said creek, Rolling fork or bayou, as the
said board of commissioners may direct and require:
Provided, the said tax shall not in any one year ex-
ceed ten cents per acre: And provided further, that
under this act, no improvement shall be made in said
creek, and no lands shall be taxed lying below the
lower end of the improved lands, or such as may
