.where there shall-be no constable lawfully authoriz-
ed to execute the same, or except in cases of forci-
ble entry and detairier in every police district in said
county, and provided. also, he may lawfully execute
suchprocess and precepts as are by law returnable
to any Circuit Court.
SEC. 2. Be it further enacted, That all su its brought
before any justice of the peace in Itawamba coun-
ty shall be brought in the police district in which
the defendant or defendahts, or any of them, may
may reside at the time of the commencement of
such suit: Provided, That the provisions of this
section shall not extend to any police district where
there shall be no justice of the peace.  .
SEC. 3. And b:, 'it fuither enacted, That all laws
contravening the provisions of this act, be, and the
same are hereby repealed.

WI-EREAs, by his last will and testament, duly
published, William Simington, of the counyof Mar-
shall, emancipated the following slaves, to-wit
Phillis, aged about sixty years; Alfred, aged about
twenty-four years; Louisa, aged about twenty-two
years Fielden, about twenty years; Caroline,
aged about eighteen years; William, aged about,
twelve years.; Mary, aged about six years, and
Margaret, aged about four years-and made pro-
