ions of this act, he or they shall forfeit and pay,
for each and every bale of cotton, the sum of
forty dollars, so injured by the use of the cot-
ton hook or other instrument as a substitute :
To be recovered by suit before any justice of
the peace, one half to be paid to the person
who shall sue for the same, and the other half
to be retained by the justice of the peace, and
to be paid over to the owner or owners of said
cotton.
Sec. 5. And be it further enacted, That
no summons or other process issued by a jus-
tice of the peace, against such offender or of-
fenders shall abate for want of form.

CHAPTER ii
AN ACT making certain appropriations therein
named.
SECTION 1. Be it enacted by tUe Legisla-
ture of the State of Mississippi, That the
following sums be allowed and paid out of
any moneys in the treasury, not otherwise
appropriated, viz:
AnTcLE 1. To L. Pitcher for services as
Picher. commissioner to examine the Agricultural
Bank, ninety dollars.
Art. 2. To S. B. Newman, sheriff of
New- Adams county, for removing - to Wood-
ville, the sum of seventeen dollars and fifty
cents.
