Sec. .3. And be it further enacted, 'fhat an al*
peal may be taken to the supreme court, or court
of chancery, from  any order, decree, or decision
,of said Orphans' court, upon the same terms and
in the same manner as is show provided by law for
taking appeals from said court, and in each and
every case when said Orphans' court may act un-
der the provisions of this act it shall reduce to
writing and spread upon the records the evidence
either verbal, or written, in which its proceedings
are founded; and all costs arising herein shall be
'borne by the individuals claiming advantage under
this act in proportion to the interest claimed by
.4pach and every of them.

Sec. 1. Be it enacted by the Senate and House
