CHAP. XXXIX.
AN ACT, to provide a remedy for collecting forfeited recogniz-
ances.
Sec. 1. Be it enacted by the Senate and House
of Representatives of the state of .Mississippi,
in General Issembly convened, I hat whenever
any recognizance, either with or without bail,
shall have been taken for the appearance of any
witness, prosecutor, or any person charged with
the commission of any crime, or offence, returna-
ble to any court in this state, and the person so
bound to appear shall fail to comply with the
terms of such recognizance, and make default, it
shall be the duty of the court to enter up a judg-
ment, nisi, against-the obligor or obligors, in such
recognizance, and his or their surety or sureties
for the amount of such recognizance, and thereup.
on a scirefacias may issue against such obligor or
obligors, as against bail in civit cases, returnable
to the next term of such court; but no defence shatll
be adnitied to such scirefacias, which is not now
allowedi by law in cases of forfeited recogaizances.
