CHAP. XLV.
An Act for the puhishment of Crimes and Misdeneanorsb
SEC   1. Be it enacted  by the Senate au Rouse of
Represe atives of the State of .1fissisppi, in genera
assembly convened, That if any person or persons,
owing allegiance to this state, shall levy war against it,
or adhere to its enemies, giving them  aid. or comfort,
within this state or elsewhere, or shall carry on treasona-
ble or treacherous correspondence with them, or shall
be any way concerned in. forming any plot oi codbina- Treson,
tion, or conspiracy for betraying this state intothe pow-
er of any foreign enemy, or shall give or attempt to give
any intelligence to such eneiy, for the purpose of be-
traying this state, or any of its forts, gailions, warlike
stores, troops or militia, into the power of any such ene-
my, every person so offending, and being thereof legal-
ly convicted, upon the testimony of two credible wit-
nesses, testifying to the same overt act, of which such
person shall stand indicted, or upon voluntary confession
of such party, made in open court, shall be deemed
guilty of treason, and shall suffer death.
SEc. 2. .And be itfurher enacted, That every per-
son who shall commit murder, or shall aid, abet, coun-
sel, hire, command, cause or procure any person or per-turdr
sons to commit murder, shall, on being thereof convict-
ed, suffer death.
SEC. 3. And be. itfurthei enacted, That every per- ptit-
son liable to be prosecuted for petit treason, or as ac-treason.
