State. The publication shall be for four weeks successively, the last nser-
tion to be at least ten days before the day said party or parties are required
to appear.
§ 6. In all cases of condemning private property of minors, the Mayor
may appoint a guardian ad litem to defend for said minors ; but no such
guardian, by virtue of said appointment, shall be authorized to receive the
damages assessed in favor of said minor. -
This act shall take effect from its passage.

AN ACT to incorporate the town of West Plains, in Howell county.

1. The town of West Plains incorpora-
ted; limits of town ; to have perpet-
ual succession; general corporate
p.; may hold real estate.
2. Who0 corporate powers of town vested
in.
3. Mayor to be elected; his term of office;
qualification of Mayor.
4. Mayor to be President of council;
council to elect a President pro tem.
5. Council to appoint clerk; duties of
clerk.
6. Council to fix time and place of regular
meetings; there maybe called meet-
ings of council.
7. Style of ordinances of said town; who
ordinances to be signed by, and to
be published.
8. What shall constitute . a quorum of
council ; council authorized to levy
and collect taxes.

§ 9. Power of council as to nuisances; as
to disorderly houses; as to gambling;
as to dram-shops, auctioneers, ped-
dlerg, and shows; as to control of
slaves; as to firing of firearms ; as
to fast driving; as to opening and
improving streets ; as to imposing
fines.
10. Council may punish by fine; for what
offenses, and to what amount.
11. Council to regulate collection of taxes;
Collector may sell property for taxes.
12. Council to appoint Treasurer and At-
torney.
13. Mayor to be conservator of peace, and
to see ordinances executed ; to cause
annual statement of expenditures and
receipts of town to be made.
14. Mayor to have powers and jurisdiction
of the Justice of Peace, and have
like compensation ; as to appeals
from judgments of Mayor.
15. When general elections for town of-
ficers to be held.
16. As to filling vacancies.
17. This act a public act.
18. Who first Mayor and councilmen.

Be it enacted by the General .dssenbly of the State of Missouri, as
follows:
( 1. That all that portion or district of country contained within the
limits of the town of West Plains, according to the survey and.plat thereof,
now in the office of the Recorder of Howell county,.shall be and the same is
hereby incorporated into, established, and erected as a town, by the name of
West Plains; and the inhabitants thereof shall be and they are hereby constitu-
ted a body politic and corporate, by the name and style of the town of West
Plains: and by that name shall be known in law; have perpetual succession,
sue and be sued, plead and be impleaded, defend and be defended, in all
courts of law having competent jurisdiction, and in all actions and matters
whatsoever; may grant, lease, purchase and bold property, real and personal,
within said town, and no other; and may have a seal and alter the same at
pleasure.
