Be it enacted by the General .dssembly of the State of     Missouri, as
follows :
§ 1. Hereafter Justices of the Peace shall have concurrent jurisdiction
with the Circuit Courts of all suits commenced against any railroad com-
pany in this State to recover damages for the killing, crippling, or injuring
of horses, mules, cattle, or other animals, by the officers, agents, servants,
or other employees of such companies, without regard to the value of such
animals or the amount of the damages claimed for killing, crippling or
injuring the same.
§ 2. All suits arising under this act shall be commenced before some
Justice of the Peace of the township in which the injury complained of was
committed, and shall be proceeded with to final judgment as in other actions
arising in Justices' Courts, except as otherwise provided in this act.
§ 3. In all actions arising under this act, the Justice shall issue a sum-
mons against the defendant as in ordinary actions in Justices' Courts, which
summons shall be directed to the Constable of the township in which the
Justice resides, and shall be served on the Station Agent of such railroad
company, if there be one in such township; and if there be no such Station
Agent in such township, then the summons shall be served by such Consta-
ble on the nearest Station Agent of such company in the county in which
the action is pending. If there be two or more Station Agents of such
company in the township in which the action is pending, the summons may
be served on one of them. The service of the summons may be by reading
the same to such Station Agent, or by delivering to him a copy thereof ; and
every such summons shall be served at least fifteen days before the day of
appearance therein named. The service of the summons in any of the modes
provided for in this act shall be a sufficient notice to such railroad company
'of the commencement and pending of the action, and such company shall be
bound by the proceedings had therein.
§ 4. In all actions arising under this act, either party may prosecute an
;appeal from the judgment rendered therein to the Citcuit Court, or other
appellate court, in the same manner, and upon the same conditions, as pro-
wided by law in ordinary actions in Justices' Courts.
§ 5. All acts and parts of acts inconsistent with this act are hereby
xepealed.
This act to take effect from its passage.
