An Act to authorize the Executor of the estate of Elisha Hughs, deceased, of Boone county, to sell a certain Slave. 1858 78 (1858)

follows:
1. That David Cauthorn be, and he is hereby, authorized to sell all
the right, title and interest of Margaret Cauthorn, Jane Cauthorn, and Mary
Ellen Cauthorn, infant heirs of Paul Cauthorn, deceased, in and to the fol-
lowing real estate, situated in the county of Audrain, in the State of Mis-
souri, to wit: the north-east qr. of the south-east qr., section 34, township
53, range 9; and the west half of the south-west quarter of section 35,
township 53, range 9.
§ 2. 3efore said Cauthorn shall proceed to sell said real estate, or any
part thereof, he shall cause the same to be appraised by three disinterested
householders of the county of Andrain ; and said real estate shall not be sold at
less than its appraised value.
§ 3. The said Cauthorn may sell the said real estate for cash or on such
credit as he may deem best for the interest of said minors ; and if said es-
tate shall be sold on a credit, lie shall cause the payment to be secured by a
lien on the real estate sold.
§ 4. Before any sale made by said Cauthorn shall be concluded, lie shall
make a full report of the proceedings, accompanied by a certificate of the
appraisement, to the County Court of Audra in county, for their approval
and if the same be approved, the said Cauthorn shall 1make a tdeed conveying
all the right, title and interest of said minors to said real estate, to the pur-
chaser or purchasers thereof.
§ 5. The money arising from the proceeds of said sale to be accounted
for by the sail Cauthorn, iilder the direction and control of said court, in
the same manner and subject to all the restrictions now imposed by law upon
guardians having money or personal property belonging to minors under
their control.
This act to take effect and ie in force from and after its passage.

Be it enacted by the General .Issembly of the Stale <f Missouri, as
follows :
§ 1. That with the consent of Rachel IIghs, widow of Elisha Hughs,
deceased, of Boone county, the executor of said decedent's estate may sell
a negro slave uiamned Mary, belonging to said decedent's estate, at public or
private sale ; Provided, Said slave shall be first appraised by three disinter-
ested persons, and shall not be sold for less than her appraised value.
§ 2. The County Court of Boone county shall appoint three disinterested
