MARION- COURT.
AN ACT to amend an act to establish a Probate Court in the city of Hannibal.

Be it enacted by the General Assembly of the State of 1Missouri, as follows:
§ 1. - That the act creating the Hannibal Probate Court, in the city
of Hannibal, approved 28th January, 1853, shall be, and the same is
hereby, amended as follows: That the Clerk of the Hannibal Court of
Common Pleas shall be ex-officio Clerk of the Hannibal Probate Court;
and that he shall, before entering upon the discharge of the duties of this
office, give bond and security for the faithful performance of the duties
thereof, as is now required from the Judge of said Court, and that he shall
be entitled to the fees now given to the Judge thereof, for like services.
§ 2.- That the Judge of the County Court for the county of Marion,
whose residence is in or nearest to the city of Hannibal, shall be ex-officio
Judge of the said Hannibal Probate Court.
§ 3. -That the jurisdiction of said court shall be extended so as to
include the whole of Mason township.
§ 4.-That the Judge, for holding this court, shall receive the same
per diem as when sitting in the County Court of Marion county, to be paid
out -of the County Treasury.
§ 5. - That all laws conflicting with the provisions of this act, are
hereby repealed, and that this act shall take effect from and after the ex-
piration of the time for which the present Judge may have been elected,
or his office shall be vacated by any cause.

AN ACT authorizing the executors of Lewis Overton to take charge of property in Marion
county, belonging to said estate.
( 1. Authorizes executors of Lewis Overton, in Callaway county, to take charge of prop-
erty in Marion county.
WTYEREAs, Lewis Overton, for some thirty years a citizen of Callaway
* county, possessed of a large estate, real and personal, therein; and,
whereas, being in feeble health, and desiring to be relieved from the cares
of carrying on his farm, and to bring about a restoration of his health,
he rented his land, hired out his slaves, and made sale of his house-
bold, kitchen furniture, and farming utensils, and made: a trip to Pal-
myra, Marion county, Missouri, taking with him a body servant and
some other little property for his comfort and convenience, where he
shartly thereafter died; and, whereas, the Clerk of the County Court
