2. The governor shall have full power and authority to direct the
manner in which such work shall. be done, as well as what kind of im-
provements shall be made.
§ 8. The warden of the penitentiary shall be allowed eighty cents per
day, for each hand that shall be actually employed as aforesaid, in the
settlement of his accounts with the state, but no money, under any pre-
text whatever, shall be drawn from the state treasury, for such work.
§ 4. All acts and parts of acts inconsistent with this act, are hereby
repealed.
This act shall take effect and be in force from and after its passage.

PERPETUATING:TESTIMONY.
AN ACT to amend an act ctoncerning perpetuating testimcoy.
1 1. Depositions may be taken, when. | a 2. General notice to be given; how and when.
Be it enacted by the General A8sembly of the State of lisouri, as jollow8:
§ 1. T hat hereafter the depositions of witnesses to perpetuate testimony
of the contents of any lost deed, or other instrument of writing, or the
krinebrance of any fact, matter or thing, necessary to the recovery or
security of any estate, real or personal, or any other right, may be taken,
,whether the party desiring the taking the same is a party, or expects to
be a party, to a suit pending, or about to be commenced or not.
§ 2. 'Tlie party applying for a commission under the provisions of this
act, shall give a general notice in the nearest newspaper to the place where
said depositions are to be taken, for four successive weeks, of the time and
place of taking the depositions, and the objects thereof; whereupon pid
depositions shall be taken; the party taking the same, in all other respects,
complying with the provisions of the act to which this is amendatory.
This act shall take effect from and after its passage.

AN ACT concerning the transportation of slaves by Railroad Companies.
( 1. Penalty on railroad companies for transporting slaves.
Be it enacted by the General Assembly of the State of lfiesouri, asfollow:
§ 1. That the several railroad companies in this state, whose officers
shall transport any slave from one point or place in this state, to any other
point or place in the same, in any car or other conveyance of said com-
panies, without the consent or permission of the person to whom such slave
does of' right belong, or who has authority to grant such consent or per-
mission, shall forfeit and pay double the value of such slave to his owner,
