said town mwe    be recovered, by action of debt, before any justice of the
pence us oth' r debts, subject to akppeal; and persons living in said town, riot
otherwise d :qUalified or incompetent, shall be competent as witneses and
jurors in a oial of such suits; but any  efendant, on request, may have a jury
summoned, consisting of persons not living in said town, and a warrant
may be gianted to bring any person forthwith for trial before a justice of
the peace for a breach of any ordinance of said town, if it appear that
there wrold be danger of losing such claim, debt or fine, if such warrant
were not issued. It shall be the duty of the chairman to cause all ordinan-
cos passed by the board to be published in such manner asbhtill by ordinance
be directed.                          t
§ 10. The chairman of such board shall, on the first kMonday in March,
of each year, make a fill and true statement of all moneys received and
expended, on account of said town, during the preceding year, and shall,
within ten days, publish said statement in a newspaper, i' there be any ir
the town, or by manuscript in six public places thevein, and if he fail to do
so he shall forleit fifty dollars for the benefit of said town.
§ 11. Any justice of the peace in said town may appoint the judges to
elect the first trustees uider this act.
§ 12. This act may be altered, amended or repealed by the General As-
senably at any lime hereafter, aid    shall take effect from    and after its
passage.
