Be it enacted by the General.ssembly of the State of lissouri, That all that parcel or tiact of land compris-Townf New Frauklin iucurpoxo ed ;id contained within the ascertained limits of the town ted. of New-Franklin, in the county of Howard, shall be, and the same is hereby erected into a corporate town by the name of New. Franklin; and the inhabitants thereof shall be, and are her-by constituted a body politic and corpor. ate, by the name and style of the trustees and citizens of the town of New Franklin, and by that name, they and their successors shall be known in law, have perpetual suc* cession, sue and be sued, implead and be impleaded, de- fend and be defended, in nil the courts of law and equity, and in all actions and matters whatsoever; may grant, pur. chase, receive and hold property, real and personal, within the said town; and may lease, rent, sell, or dispose of the same,for the benefit ofeaid town; and may do all other acts, as natural persons; may have a common seal, and break and alter the~same at pleasure. Sec. 2. Biit further enacted, That the corporate pow- ers and duties hereby granted shall be vested in a board corporate poweo of trustees consisting of seven persons, and that the follow- in whom vested, ing named ;ndividuals shall compose said board for the time being: Abiel Leonard, David Workman, Nathaniel Iutchinson, Joshua Hobbs, Alphonso Wetiore, Lewis Switzler and Lindsey P. Marshall; the first Wamed to be chairman of said board; who shall continue in office until their successors are duly chosen and qdalified, according Trusteesby whom to the provisions of this act. The trustees hereafter to be elected. chosen shall be elected by the qualified electors in the town of New-Franklin, on such day in the month of May next, as the above named trustees shall designate; which day of election may be thereafter varied, as the board of trustees, in the bye-laws or ordonance of said town, may di- rect. The trustees thus elected shall continue in oufice Tre to nte. ote year, and until their successors are duly elected and qualified. Sec. 3. Be itffurther enacted, That no person shall hold qualification of the oflice of trustee, unless he be a 11dent of the town of Trusees.
