Sece. 2. /d be it enacted, That the commissioners here- nmag
by appointed, or a majority of them, bhall value and aseer-
tain the damages that may be sustained by any person or
persons through whose lands the aforesaid road may b6
made to pass,.taking into consideration the advantages and
disadvantages, if any, and the damages when so ascertained
and certified to the commissioners of said counties, shall be
levied and assessed at their first levy, and collected as other Lej
counly charges are within gaid counties, one moiety in
each, and shall be paid over by the county commissioners,
wherein such damages may be sustained to the person or
perious entitled thereto.
Sec. 3. And be it enacted, That the said commissioners, Oath requir4
before they proceed to act, shall personally take an oath or
allirmation before some justice of the peace, that they -will,
without favor, partiality, or prejudico, assess the damages
sustained by the persons through whose land the said road
may pass.
