leaving his office either by removal, absence from the State or
resignation, or his heirs at his death shall ie bound under all
the pcialties of tile hnd to represent all the books and papers
which may have been mentioned in the inventory and such as
he may ihave received since or to procure other similar and that
in case said books cannot he represented or procured he shall
pay such sumn not exceediit the anomnt of the hid as bv the
.;ecretary of state and the treasurer or state fr the time bing
shall be deemned a s-llicient compensation for the loss of such
hooks or shall be s:ied with his security for said sumt before aiy
court of' competent jurisdictim.
