W        HEREAS the feveral offences which
are included under the denomina.
tion of murder, differ fo much from each
other inlthe degree of their attrocioufnefs,
that it is unfit to involve them in the fame
punifhment ;
Sec. I. Be it therefore enaled by the go-
vernor of the territory of Orleans, by and
with the advice and coti/ent of the legi/ative
council thereof, That all murder which thall
be perpetrated by means of poifon, or by
lying in wait, or by any other kind of wil.

rape, robbery or burglary, thall be deemed
murder of the firft degree; and all other
