An Act to revive and put in force the third and fourth sections of an act
amending an act to incorporate the town of Lunmpkin,# in Stewvart
county, approved January 17th, J850; to add additional sections there-
to; and to amend the charter of the city of Dalton, andfor other pur-
poses.
1. SECTION I. BP it enacted, it,., That the third and fourth sec-
tions of the Act entitled an Act to amend an Act to incorporate tihe novIv  s,
town of Lumpkin, in Stewart county, assented to December 26th,'n nt '
1831, approved January 17th, 1850, be and the same are hereby7IJm
re-enacted and put in full force; and the Acts assented to Decem-
ber 22d, 1857, and Decemlber 11th, 185S, repealing the aforesaid
section, be and the same are hereby repealed.
2. SLC. II. And be it farther enacted, That the Conuissioners of
said town of Lumpkin are hereby authorized, in lieu of levying and Mann or
collecting a road tax, as provided for in the aforesaid acts incorpo-woru dS
rating said town, and those amendatory of the same, to apportion
the persons and hands residing within the corporate limits of said
town, who are subject to road duty by the laws of this State, to
such, and as many overseers as may, by them, be deemed proper;
and shall divide out the public streets of said town among the said
several overseers, and the hands apportioned to each respectively;
and in that event the said overseers and road hands shall be subject
to the same duties and liabilities, and have the same rights and
privileges as other overseers and road hands according to the gene-
ral laws of this State; and the said Town Commissioners shall
have the same power and authority over, and be subject to the
same penalties and liabilities in relation to, the said overseers, road
hands, and public streets, as are prescribed for Road Commissioners
by the laws of this State.
3. Suc. III.. And be it further enacted, That in the event the said
Tvown Counuissioners shall not he elected, or if elected shall fail or\;\t.,1 c'r
refuse to discharge the duties prescribed for them in this act, andofHow
