SEc. 2. And be it further enacted, That the third section
of the act of which this is amendatory, shall be so amended
is hereafter to read and be as follows: SECTION 3. And be
It furither enacted, That when a Sheriff shall levy on proper-
ty by virtue of any execution directed and required by the
second section of this act, (as licreinbefbre amended,) said
property shall be sold in the county in which the levy may
be made, and that whenever any decree, order, ca. sa., at-
tachment for contempt, or final process, directed as requir-
ed by the second section of this act, (as now amended,)
shall be placed in the hands of any SherifF, and under and
by virtue of said process, it shall become the duty, under
the laws of this State, of said Sheriff to imprison any defien-
dant or other delinquent, it shall be lawful for said Sheriff
to arrest. the delinquent wherever found, and it shall be his
duty to imprison him or her either in the county where the.
arrest was made, or in the county where the arresting Sher-
iff may reside, at the option of' the plaintiff or other person
so requiring the services of said Sherifl'
SEc. 3. And be itfirther enacted, That when anyjudgment
has been or shall be rendered, in any of the Courts of this
State, upon any note or other evidence of debt, given for the
purchase of land, where titles have not been made, but bond
tir titles given, it shall and may be lawful for the obligor in
said bond to make and file, and have recorded in the Clerk's
office of the Superior Court of the county, a good and sufli-
cient deed of conveyance to the defendant for said land;
and thereupon the same may be levied on an4 sold under
said judgment as in other cases: Provided, That the said
judgment shall take lien upon the land prior to any other
judgment or incumbrance against the defendant.

and it is hereby enacted by the authority of the same, That
