poratc limits of the city of Dalton, the sum of three dollars
each, to be collected and applied as before specified.
SEC. 19. And be it further enacted, That it shall not be
lawful at any time for the persons within the corporate lim-
its of said city, who are subject to road duty, to be compelled
to perform road duty without the limits of said city, neither
shall it lie lawful for any citizen or person who resides with-
out the limits of said incorporation, to be required to perform
road duty within the limits of said city.
SEc. 20. And be it further enacted by the authority aforesaid,
That all laws and ordinances herein contemplated and au-
thorized are in no instance to militate against the laws of
this State, or of the Constitution thereof; that all laws and
parts of laws, militating against this act, be, and the same
are hereby repealed.

AN ACT to amend an act entitled an act to incorporate
the town of Marthasville, in the county of DeKalb, pass-
ed on the twenty-third day of December, eighteen hun-
dred and forty-three; and also to enlarge the boundary
of said town, and to incorporate the same under the name
of the cityof Atlanta; and to change the name of the town
of Rome to that of thd city of Rome; to provide for The elec-
tion of a Mayor and City Councilmen and other officers of
said cities, and to confer upon them s ecified powers; and
for other purposes herein mentioned.
SECTION 1. Be it enacted I the Senate and Howse of Repre-
sentatives of the State of Georgia in General Assembly met, and
it is hereby enacted by the authority of the same, That from and
after the passage of this act, the town of Atlanta shall be
known and called the city of Atlanta, and the authority and
jurisdiction of said city shall extend one mile from the State
Depot in every direction.
SEC. 2. And be it enacted by the authority aforesaid, That
within sixty days after the passage of this act, by giv-
ing two days notice, and on the third Monday in every Jan
uary thereafter, all free white persons, citizens residing
within the incorporation of said city, who shall be entitled
to vote for members of the Legislature of said State, shall
be entitled to vote for a Mayor and six members of the City
