AN ACT to amend an act passed 20th December, 1835, en-
titled an act more effectually to protect ,free persons of
color, and to point out the mode of trying (he right of free-
dom.
Whereas, free persons of color are liable to be taken and
held fraudilently and illegally, in a stnte of slavery, by wick-
ed white men, and to be secretly removed whenever an effort
may be made to redress their grievances, so that due enquiry
cannot be had into the circumstances of the detention of the
same, and their right of freedom, for remedy whercof,
SECTION 1. Be it enacted 1,1 the Senate and House of Re-
presentatives of the Sta/c of Georg ia, in General Asecmbly met,
and it is hereby enacted by the authority of the same, That it
shall and may be lawfil for any Justice of the Inferior Court
of any county of this State, upon the complaint of any free
white person upon oath, showing that he has good reason to
believe, and does believe that any person or persons of color
are free, and are frandulently and illegally held in slavery, the
said oath to be made in the county where the persons owning
such slave may reside, to kstie his warrant, directed to the
Sherifl of said county, or any lawful Constable thereof, re-
quiring the said Sheriff or Constable, as the case may be, to
arrest tile person or persons so holding such person or
persons of color in slavery, as well also the persons of
color, and cause the same to be brought before him, that due
enquiry into all the circumstances of the case may be had, and
and if' upon such examination, the said Justice shall lie satisfied
that there is probable ground to believe that such person or
persons of color are improperly and illegally held in such a
state of slavery, it shall be his dut to require such person or
persons so holding and illegally detaining such person or per-
sons of color to enter into bond with two or more good and
snflicient securities, payable to such person giving such in-
formation and filing such aflidavit as the prochein ami of said
persons of color, in a sum of double the aiount of the value
of said person or persons of color would be if' they were slaves,
conditioned, for the delivery of' said person or persons of col-
or, and a compliance with the final order and decree to be had
in such c.ses, to be instituted agrecable to the provisions of
the act for the freedom of' the same, and lirther conditioned
that said person or persons of color shall not be removed be-
yond the limits of' said State, and on their failure to enter inl-
tv such bond as aforesaid; it may and shall be lawfil for the
said Justice aforesaid to cause the said person or persons of
color to be delivered to the person filing the said aflidavit, on
his giving bond with two or more good and suflicient securities
payable to such person or persons holding said person or per-
