PENAL CODE.
AN ACT to reform, amend, and consolidate the penal laws of
the State.of Georgia.
SEc. 1. Be it enacted- by the Senate and House of Represen-
tatives of the State of Georgia, in General Assembly met, and it
is hereby enacted by the authority of the same, That the existing
code of the penal laws of this state, shall continue and remain
in full force until the first day of June next; at which time, the
following Code of Penal Laws shall be in fall force and operation
in this State.
FIRST DIVISION.
Persons capable qf committing Crimes.
SEC. 1. A crime or misdemeanor shall COilsist in a violation
of a public law, in the commission of which there shall be an
union or joint operation of act And ititention; or criminal negli-
gence.
SEC. 2. Intention 1vill be manifested by the circumstances
connected with the perpetration of the offence, and the sound
mind and discretion of the person accused.
SEC. 3. A person shall be considered of sound mind, who is
neither an idiot, a lunatic, or afflicted by insanity; or who hath
arrived at the age of fourteen years, or before that age, if such
person know the distinction between good and evil.
SEc. 4. An infant under the age of ten years, whose tender
age renders it improbable that he or she should be impressed
with a proper sense of moral obligation, or be possessed of suffi-
cient capacity deliberately to have committed the offence, shall
not be considered or found guilty of any crime or misdemeanor.
