AN. ACT to regulate the trial of cluiu to Land aii -Negroes, when
levied on by attaclinients in the Justice's Courts iu this State.
Be it enactid by the Henate and House of Representatives of the
State of Georgia in General s.isemb1y met, and it is hereby enacted
by, the authority of the same, That from and after the passage of this
act, when any attachnent returnable to a Justice's court in this state,
shall be levied on land which has becu claimed by tny person or
persons not i party to said attachimieit, it shall he the duty of the
oficr levying the same, to return the claun papers to the clerk of
the next Superior court of the county where the land lies, which
court shall cause the right of property to be tried in the same manner
as in other claim cases.
Sec. 2. .1nd be it further enacted, That when anyattachment as
aforesaid, shall be levied on any ngro or negroes which any he
claiued as albresaid, it shall be the duty of the levying oflicer to re-
turn the claim papers to the clerk of the next Superior or fiferior
court of the county in which said attachment has issued, and it
shall be the duty of the courts aforesaid, to cause the right of proper-
tv to he tried in the same manner as its other cases of clains.
See. 3. And be it further <nacted. That the person or persons
claiming as aforeaid, shall present their claim in the same ananner,
and he entitled to a replevy under the same rulet and regulations as
in other cases of attachncnts and claims.
Soc. 4. And be it further enacted by the authority aqresaid, That
the jury, before the trial of any of the claims aforesaid, shall have
administered unto them the following oath, to-wit
You do swear or alffirm, that you will give to plaintiffs in attach-
ments against claimants, such damages as may seem reasonable and
just, not less than ten per cent : Provided, it shall sufficiently ip-
pear that the clain was intended for delay only-So help me God.
See. 5. And be it further enacted by the authority aforesaid, Thai
all laws or parts of laws militating against this law, bo and the sanie
are hereby repealed.
