AN ACT
To provide for taking the census of tuis state as required
by the constitution.
Be it enactel by the Senate and House of Representa-
tives of the State of Georgia, in General Assembly met,
and it is hereby enacted by the authority of the same, That
it shall he the duty of the justices of the inferior courts or
any three of them in each county respectivi ly in ninety4
days after the adjournment of this legislature, to appoint
one or more persons in each county. that is to say, OnIe
person in each battalion that may be in the respective
conties, Ndhose duty it shall be to take a full and accurate
census or enumeration of all the free white persons and
people of colour residing therein, distinguishing in separate
columuns the free white persons from those of colour, and
return the same to the clerks of the superior courts of the
several counties, certitled under their hands, on or hefore
tihe 1irst day of October next, the persons so appointed
being first severally sworn before the said justices, or either
of them, duly and faithfully to perform the trust reposed
in them: and it shall be tihe duty of said clerks to trans-
nit all such returns to his excellency the Governor on or
before tihe first Monday in November next, to be by him
laid before the legislature; and it shall be the duty of the
legislature then in session to apportion the members of thep
Ious~e of Representatives among the several counties,
agreeable to the plan provided by the constitution.
Sr.:c. 2. And be it further enacted, That in case the
justices of the inferior courts shall fail to appoint persons
to take the enu meration within the period of ninety days
after the ajmrnment of the legislature, that the justices
of the peace, or any three of them, shall have and exercise
like powers respecting the said censu,4, [and if the census
