of holding general elections in the several counties of this state, in tie
same manner as is prescribed for the election of Membeis of the Ge-
neral Assembly. The returns of every election for-Governor, shall
be sealed up by the presiding justiceF, selprately from other returns, di-
rected to the President of the Senate, and the Speaker of thc House
of Representatives, and transmitted to hid Excellency the Givurimr,
or the person exercising the duties of Governor, for the time being,
who shall cause the spme to be laid before the Senate, on the day of ter
the two flouseishall have been organized, and by the Senate sent to
tie [louse of Representatives. The Members of each Branch of the
G neral Assembly, shall convene in the. Representative Chabei, on
the same day that the returns are laid before them ; and the President
of the Senate anid Speaker of the House of Representatives, shall open
and publish the returns in presente of the General Assembly, and the
person having the majority of the whole number of the votes given in,
shall be declared dulv elected Governor of this State ; but if no per-
son have such majority, then from the persons having the two highest
number of the vote , the General Assembly shall elect immediately, a
Gove: nor by joint ballot ; and in all cases of election of Gove, nor by
the General Assembly, a majority of the voles of the Menhent. pre-
sent, shall be necessary for a c-oice. Contested elections shall be de-
termined by both lloutes of the General Assembly, in such manner as
shall be prescribed by law.

To alter and amend the several laws for the trial of Slaves and Free
Persons of Color in this State.
§ 1. Be it enaeted by the Senate and Hbouse of Representatives of lie
State of Georgia in General A1ssembly met, and it is hereby enacted
by the authority of the same, That from and after the passing of this
ai, the following shall be considered as capital offences, when com-
mitted by a slave or free person of color:-insurrection or an attempt
to excite it; committing a rape, or attempting it on a free white Ic-
male ; murder of a free white person, tr murder of a slave or free
p.i in of color, or o n in g, of a human being ; every and each of
tlse olfences, shall on coiviction, be punished with death : aid the fol-
