persons, inhabitants of said town, other than freeiolder,
shall be eligible to the office of commissioner of said
town, and it shall not be lawful for such commissioner so
to be elected as aforesaid, to enter upon the duties as-
signed him or them by virtue of this act, until they and
each of them, have first taken and subscribed an oath be.
fore some one of the Justices of the Inferior court or Jus-
tices of the Peace for the county of Wikes, to support the
constitution of the U. States and the constitution of this
state, and such other oath as shall be prescribed by
them or a mtajoritN of theni, not inconsistent with the con-
stitutions and laws of the land.
§ 6. And be it further enacted, -That the said Com.
inissioiers, or a majority of them, shall have the control
of the inhabitants of the said town, liable by the laws of
this state to work on roads, for the purpose of opening
and keeping open, the streets of said town, and workiig
on the same, and on the roads leading to and from the
said town for the distance. of one mile.
