United States, any law of this Territory, or any order
of the county courts of this Territory.  I .
Sec. 3. rnd be it further enacted, 'That the county
courts of this Territory shall not have power to alter
or change the route of the road through this Territory,
authorized by the act ofCongress, entitled as act to
authorize the laying out and opening certian public
roads ini the Territory of Florida, Approved February
twenieth, one thousand eight hundred-and twenty
fotr.

AN ACT
Condcrning sfarico,

Be it enacted by the Governor and Legislative Coun.
c il oithe Territory of Florida, That when any person
Personi of c O.  of colour shall claim his or their freedom, it shall and

freedom.      ray be lawful for any white person, giving bond with
sufficient security for the payment of all costs and
damages, which may accrue, to bring in the name of
such person of colour an action of trespass against a-
py person or persons, claimirg any propierty in, or be-
ing in possession of such person ofcolour, and ifjudg-
inent shall be given far the plaintiff, a special entry
shall be made, declai ing that the person in whose natne
the action is brought, is free; ProvidedI that in any.
action or suit to be brought in pursuance of the pro-
visions of this act, the burthen of the proof shall lie
on the plaintif, and it shall always be presumed, that
every person held as a slave, is , slave, unless the
contrary be made to appear.
Sec. 2. Be it Ourther enacted. That the emancipation
of a slave shall not be complete, if' it he to the prejtt.
Emanclpation  dice or a contract previously made, and unless such
qfflaves,     slave be of sound mind and body, and' of an age over
twenty years, anl under forty five, and unless the act
of emnincipatioii be set forth in a-written acknowledge-
