AN ACT
To regulate the counties and establish county courts in the
Territory of ilovida.
Be it enacted by the Governor and Legialative Coun-
cil of the Territory of Florida, That there shall be or-
ganizec in each of the counties or this Territory a
county court to be composed of three Judges to be ap-
pointed by the Governor and Legislative Council, and
Compnscd of   to hold their office during good behaviour, subject
three judges.  however, to he removed from office at any time by the
Governor, and a majority of the Li-gislative Council;
one of the said judges shall be designted by the Go-
vernor to preside; any two of the said Judges shall be
a quorum, and shall constitute a court.-The said
judges shall respectively possess'and exercise all the
powers, and perform all the duties of justices of the
peere within their counties according to the limits,
vWlich may be prescribed to the exercise of theirjuris-
diction as justices afuresuid by the said judges, when
sitting as a Lounty court. They shall befoic they en-
ter on the duties of their office, take an oath to sup-

fully to execute the duties assigned them without par-
tiality, favour or affection.
Sec. 2. dand be it further enacted, That the county
Jurisdiction.  courts, thus estabhished, shall within their'respective
lals4ctin. counties exercise original jurisdiction over all suns
above twenty and under one hundred dollars, and ap-
pellate jurisdiction over the judgments of justices of
the peace, and concurrent jurisdiction in all 6ivil cases
above a hundred dollars with the superior courts, both
in law and equity, saving to all persons the right of ap-
peal or writ of error to the superior court. And that
the said court s hall have no criminal jurisdiction ex-
cept in cases, where the judge of the superior court
shall be the party accused, or the said superior court
for any other cause cannot take cognizance; then and
in that case it shall be the duty of the prosecuting at-
proviso,      torney to give twenty (lays notice before the term  to
the jtdlges of the said county court, and the said judg-
es shallcause a venire facias to be issued, and-a grand
jtry organized for that special purpose, and the decis-
ion of the said county court in all such cases shall be
final; ProVided, that whenever any suit shall be insti-
