Sec. 12. .nd be it.further enacted, That if any per-
son shall without the consent of the said comnmissi)n.
ers or a majority of'them, cut down or otherwise dce.

town site or so much thereof as shall continue public
lplopertY, such person shall be Subject to a penalty of
ten dollars for every trec so cut down or destroyed lo he
sued for, before any justice of the peace in Gadsden
county, said penalty to belong to and he appropriated
to the use of said town of' Tallahassee, and to be paid
over to the said commissioners, and to be by them dis-
posed or in like manner as other moneys, which may
come to their hands under the provisions of this act,
are disposed of.

.Be it enacted by the Governor and Legislative Council
lortgage as.  of the Territory of Florida, That it shall and may be
sgmile.    lawful for any mortgagee or mortgag'ees to assigin and
transfer any mortgage made to him, her, or them. And
the person or persons, to whom an) mortgage may be
jissigned or transerred, may also assign avid tiansfer
it, and they and their assigns, or any subsequent as-
signees, may lawfully have, take, and pursue the same
ineans and remedies, which any mortgagee can or may
lawfully have, take, or pursue, for the foreclosure ofany
mortgage, and for the recovery of the money secured
thereby.
See. 2. Be it further enactcd, That a mortgage shall
be foreclosed under this act, in the following manner,

loreclosure of any mortgage, may file his, her, or their'
petitio-i in the supet.ior court of the district, in which
the mortgaged premises are situated, when they are
real p'ollerty, or in which the mortgaged property
may be, when it is personal property; which petition
