'AN ACT,
Respctinj the probate of wills and the granting of lettere testa.
men     and    ofadmnistration, and the duties of exectu-
tot* admlnisti-atorkand guaidians..
Be it enacted 6y the Governor and Legislatite Coun-
cit of the Territory ofFlorida, That it shall bie the du.
ty of the' conty' courts in the Several countles of this
Territory, in term time, and of the judges of said courts
in vacation, to take. proofs of all last wills 'and testa-
ments, and to grant probates, letters testainentary and
letters 'of -administration, with or witl6t an'y will an-
nexed, and to do6 and perform all muttei's and things en.
joined on said courts, or the judges theriof lnrelation
to the est'tes.of deceased persons.
Sac. '2. E6 it-further enacted, That no.person shall
,be qualified or permitted to act as an executor execu-
triix, administrator or administratrix, unless . he be
twenty' one years of age or upwards, and in the case of
minol's being named excutors in any last will and tes-
tament, the letters testamentary shall be granted to the
other executor or executori., if any be named ii said
01il1 or testament, or if none others be nated, letters of
