The following is the title of a suit in respect of the same seizure against the
Provost, consort of the  Whitehaven, commenced in the High Court of
Admiralty. It was before the Court upon the day on which the above decree was
made in Lutwidge v. Vatable, and after that decree appears not to have been
prosecuted.
Petrus Vatable, Petrus Garesche et socii proprietarii navis cujusdam vocata
the  Jane de Dublin, cujus Petrus Richards nune est vel nuper fuit magister,
ejusque, &c., et bonorum, &c., in cAdem per navem quandam privatam bellicam
vocatam the  Whitehaven, galley, in consortio alterius navis privatmo bellicw
vocatme the  Provost, galley, cujus Josephus Wheeler est Capitaneus, capta et
seizita contra dictam navem the  Provost, galley, ejusque, &c., et tormenta
ejusdem, dictumque capitaneum Wheeler in specie, necnon contra Nathanaelem
Wraxall et socios pro interesse suis in eisdem intervenientes.
[302] FOWLER V. LIVING.      The John and Mary.       1714.-Dispute   as to
possession of masts and rigging. Decree for delivery of same, and for £100
damages. Ad. Ct. Assignation Book, 4th July 1714.
Johannes Fowler proprietarius navis cujusdam vocatae the  John and Mary,
Hoy, ejusque, &c., contra quendam Thomam Living.
Ad audiendum sententiam.
Goodale petiit sententiam per eum ultimo die juridico porrectum legi et ferri,
Willymott dissente. et petente partem suam dimitti. Dominus auditis, &c., finaliter
interloquendo ad petitionem Goodale decrevit prout insequitur : That the masts
and rigging be restored to Fowler; and condemned Living in £100 damages and
also in expenses. Goodale porrexit billam expensarum; Dominus taxavit candem
ad £90 . . . Goodale fecit fidem de expensis, &c. Monitio ad tradendum vela, &c.,
et ad solvendum sortem principalem et expensas infra mensem, non extrahenda
infra 15 dies, pro damnis et expensis.
TAYLOR V. THOMPSON. 1714.-Personal action for damages by owner against
master; Ad. Ct. Assignation Book, 12th Nov. 1714.

Carolus Roakes est magister), ejusque, &c., contra Thomam Thompson magistrum
navis cujusdam vocati the  Patience  de Arundell in causA damni.

1714.-General order as to sealing of warrants ; Ad. Ct. Ass. Book, 11th Dec.
1714.
The Judge (Dr. Newton) declared that all warrants which are to he sealed shall
be sealed with the seal of the Lords of the Admiralty, their Lordships having given
leave to use the same, and that the words  sub sigillo Officii magni Admiralli Nostri
magne Britanniuo, &c., quo (sic) in hhc parte utimur  be used instead of the words
sub sigillo magno vel ad causas; and also that he appointed Walter Graw officer
of the Court till further order.
HANSON V. GODFREY. 1718.-Wages. Proportionate part of wages decreed up
to loss of ship ; Ad. Ct. Assignation Book, 12th March 1718.
