LAWS OF THE

CHAPTER DCIV.
Preamble.  WHEREAS, it is represented to this General Assembly that, at the
Court of General Sessions of the Peace and Jail -Delivery of the
State of Delaware, in and for the county of New Castle, to wit:
At the November Term of the said Court, in the year of our Lord
one thousand eight hundred and fifty, a certain Thomas Demby, he
the said Thomas Dcmby being a free negro, was convicted of steal-
ing money from a certain Daniel Stephens, also a free negro, and
sentenced by the Court to be whipped with twenty-one lashes; to
stand in the pillory one hour; to pay a fine of one thousand dollars,
and to be sold as a servant to the highest bidder, for the term of
- years. That the said convict received his whipping, and stood
his hour in the pillory, but that the Governor remitted the residue
of his punishment. That for the costs in the case, amounting to
the sum of one hundred and sixty-nine dollars and thirty cents, the
said Thomas Demby gave his hond with a certain Charles H. War-
ren as his surety, to the Sheriff of New Castle county, which bond
is still unpaid. That fi-om facts which have been disclosed since
the said conviction, it appears probable that the said Demby was
not guilty of the crime of which lie was convicted, and ought not to
pay said costs.
Costs relin.  Be it therefore resolved by the Senate and House of Representa-
quished  to tives of the State of Delaware, in General Assembly met, That the
Thomas   costs in the case of the conviction aforesaid, be and the same are
Demby.   hereby relinquished and remitted to the said Thomas Demby, and
Sheriff direc- that Samuel G. Chandler, Sherill of New Castle county, is hereby
bod, c  authorized and required to cancel the said bond so taken by him for
said costs as aforesaid, and deliver said bond so cancelled, to the
said Thoias Demby.
