CCCLXII.
AN *ACT providing for the punishment of certain  1826.
crimes and nasdemeunours.
SECTION 1. BE IT ENACTED.by the Senate and
House of Representatives of the State of Delaware,
in Generalldssembly met, That the crimes and mis-
demeanours, hereinafer mentioned, shall be punish-
ed as hereinafter prescribed, that is to say,-
If any person or persons shall commit treason a.1. rreason.
gainst this State; every p'erson so offcnding, upon
conviction thereof, shall suffur death.
If any person or persons shall commit the crime. Murder.
of nuirder, every person so offending shall be dee- Sec 10, b.
med gilty of feony, and, upon conviction thereof,
shall buffer death :-And also if any person or per-stroke in this

and malicously, shoot, strike, stab, wound or poisonther;
any person, vho shall, within one year afterward, die
of such shooting, striking, stabbing, wounding or
poisoning at any place without this State,-every per-
son so. offinding, (notwithstanding the death shall
happen without the State,) shall be deemed guilty of
murder and felony, and, upon conviction thereof,
shall suffer death.

crime, to wit, manslaughter of the first degree, and
manslaughter of the second degree:-
Voluntary manslaughter, excepting manslaughtero1 the first
voluntarily committed by a husband on a persondegre,-
found in the 'act of adultery with his wife,-man-
slaughter involuntarily committed, in the prosecu-
tion of an unlawful act or purpose, but not of such
a character as to constitute the offence murder,-and
manslaughter involuntarily committed in the per.
formance of a lawfit act, but under circumstances, or
in a manner, or by means, which cause an apparent
danger of inflicting death, without using due precau?
