'Preamble.         HE REA Sgreat injuftice and many incon-
WV veniences have heretofore arifen from free black
perfons and free mulattoes not being allowed to give
teftimony in Courts of Juffice:
BE it therefore enaded by the Senate and Honfe of Re-
prefentatives of the State of Delaware in General Af-
fembly met, That from and after the paffing of this
a&, in all criminal profecutions, where it [hall ap-
pear to the Court before whom the profecutions are
depending, that no white perfon or perfons compe-
