In relation to the competency of witnesses.
SECTION 1. Be it enacted by the Senate and House of
Representatives of the State of Alabama in General Assem-
bly convened, That in suits and proceedings before any Witness no
court or officer in this State, other than criminal cases, to be excluded
there shall be no exclusion of any witness, because he is binte-o

laws of this State,) neither party shall be allowed to tes-
tify against the other, as to any transaction with, or
statement by the testator, or intestate, unless called to

SEC. 2. Be itfurther enacted, That sections 2276, 2277,
2313, 2314, 2-315, 2290, 2291, 1568, 2287, 22S8, 2316, sections of
1607, 1608, 2935, of the Code of Alabama, and an act repealed.
