force, or by keeping out of the way, or who shall wilfully
fail or refuse to permit, any person, upon application by,
counsel, in his custody, ;tbcodisult with, .and.havd the
assistance -of counsel f6r the purpose of, suing 'out or
prosecuting said: suit, br who shall. sendaway or conceal
any .person who is iu'custody or under his control; with
intent to prevent said writ from beingr sued out or execut-
ted, or the petitioner from: being discharged when the
Judge or court so brders,.shall be guilty of a felbny, and,
on coiwiotion.,khnlk'bo fined not loss than one thousand
dollars, or imprisoned; in the penitentiary nbt less than
one nor:more- than five years, at the discretion of the
jury trying the same. ..             .
S 820. 2. Be 'it further. exacted, That it shall bo the duty
of , the Governor .to arrange, if possible, with ! thei Con- .v.rnor so
federate   Government for, the employment of the :militia dorovot duty
and; county reservesin arresting and returning deserters,**
and out-lying persons who a re liable to render military
service to the Confederacy', on the condition that the:Con-
federate Government will recall apd place in active milita-
ry servico,the cavalry and other forces now employed in
that duty in various parts of this State, as far as consist-
ent with the common defenso and general welfare.., It
shall also be the duty of the Governor, to arrange, if
possible, with ,the Confederato:,Government for the
emplo5'ment of the militia and county reserves, or of any
mlltary comp anies or fire companies existing;in this State Military and Fire
and, not legally bound to ronder. military service, outside companies ala..
of this Btate, in performing piovoet guard duty in thit
State, so, as to strengthen the Confederate army, by -llow-
ing those belonging to the Contederate army who may be
performing -provot guard duty to. be put' i4 active
service in the field against the enemy.
