[No. 412.]            AN ACT
For the relief of Mary C. Waters.
SEC. 1. Be it enacted by the Senate and House of Reprnesen-
tatives of the State of alabama in GeneralvAssembly convened,
Maysue fordi.That it shall be lawfui for Mary C. Waters, of the county
vorceinless of Lowndes, wife of Jonathan P. Waters, and by him
than 3 years. abandoned, to institute suit in any chancery court of this
state for divorce from the said Jonathan P. Waters, her
husband, in less than three years from the time of her
abandonment by him ; and if, in the opinion of the court,
said Mary C. hath just and sufficient cause for desiring to
be divorced from her husband, the said Jonathan P., it
shall be lawful for the chancellor of said court to decree to
said Mary C. a divorce, dissolving the bonds of matrimony
existing between her and said Jonathan P. Waters ; any law
to the contrary notwithstanding.

SEC. 1. Be it enacted by the Senate and louse of Refpesen*
tatives of the State of ./1abama in Gencral.Assembly convened,
Right relin- That any right to the estate of Tom, a free man of color,
quished.  who died in the county of Dallas, which has now or may
hereafter accrue to the State of Alabama by way of escheat,
be and the same is hereby relinquished.
.       SEC. 2. Be it furlCher enacted, That the negro slaves be-
Emaneipated, longing to the estate of said Tom, to-wit: Charity, his wi-
dow, and Malinda, Sarah, Organ, Miles and Rebecca, his
children, with the increase of the females, be and each and
every of them hereby is manumitted and forever set free
from the bondage of slavery : Provided, They and every
'O  'of them shall within two years from the passage of this
act remove themselves or be removed beyond the limits of
Proviso,  this state: And provided furtheir, That Garland F. Gard.-
nor execute bond with good security, in the sum of two
thousand dollars, payable to the judge of the probate court
of the county of Dallas and his successors in office, con-
ditioned to remove said persons of color beyond the limits
of this state within the time prescribed by this act.
