of Madison county,. upon petition of the ailministrator,
setting forth the grounds of application and the debts to be
compromised or sold, which petition must be verified by
aflidavit and the facts sustained by the written evidence of
two respectable witnesses upon hearing the application
tie facts thus stated and proved' must be sufficient to
satisfy the court of probate that the estate of the said David
Moore will be materially benefitted by such compromise or
sale.

Seec I. Be it cuacted by the Senate and House of Re'pressc-
L(itives ofthe Statc of'.llabana in General /Jssenbly convencd,
Certainnegro -That William N. Waller, the guardian of Alfred. Loftin,
oe r may petition to the court of probate of Montgomery county
for leave to sell the negroes of his said ward, naming the
negroes and relating the ground of application for a sale,
which polition must be verified by the alidavit of the guar-
dan, and the facts therein set forth must be fully sustained
by the testimony of Iwo responsible witnesses; upon such
application and proof, if the court is satisfied the interest
of the estate of said Alfred will be materially and perma.-
nently bLnefitted by a sale of negroes, the court may de-
cree a sale under sLIch orders as the interest of the estatc
demand.
