,parts of laws contravening the provisions of this act be and
the same are hereby repealed.

To incorporate the town of McKinley, in Marengocounty.
Sc. 1. Be it cnaced by the Senate and House of Represen-
tatives of the State of llabanwn General/ sserbdl convened,
That the town of McKinley, in Marengo county, be and the incorporati,
same is hereby incorporated ; an(] the bonndary of said cor- Boundarie.
poration shall be one mile square, and shall be so laid off
and definei 'as to make the public well the centre thereof.
SEc. 2. 3e itfurther enacted, That an election shall be
held, on the first Monday in March next, at The post-oflice i
said town, begining at It o'clock, A. M., and closing at
.3 o'clock, P. M., for the purpose of electing by ballot one
intendant, five conncillors, inhabitants of said town, and
annually thereafter, noder sich riles and regitations as the
intendant and council may hereafter prescrbe, who shall
serve for the term of one year after they shall have been
elected. The first -election shall he managed by Enos
Rodgers, P. P. Dniel, M. 1. Smith, Danel M. A. Dansby
and S. T. Newton, or any two of thiem, and all subsequent
elections shall take place ott the first Monday of March in
each and every year, and shall be held by two of the cotn-
cillors appointed'by the board for that purp so ; and if the
said board-shall fail to hold an election according to the
terms of this act, then it shall be lawful for the freeholders
ofl-said town,;after giving ten days' pttblic notice by adver-
tisement, to hoid said election ; and the intendant and coun-
cillors shall, 'withiin ten days after their election, ill ech year
meet together, and before entering upon the discharge of
,their duties, shall take and suibscribe the followintg oath
befori. ny justice of the peace for said county, viz  1 do
solemnly swear (or affirm as the case may be) that I will
well aid truly and to the best of my knowledge and belief
.execeite and discharge the duties of 'intendant (for intend-
ant) councillor (for councillor) of the town of McKinley
ayiihout fear, favor or affection : So help me God.
