one or more of said Commissioners, should refuse, or fail to
act as Commissioners, such vacancy shall be filled by the re-
maining acting Commissioners; and the town Commissioners
aforesaid, are hereby empowered to name said county site.
I Sec. 4. .V1nd be itfurther enacted, That all laws and parts
of laws, contravening the provisidns of this act, be, and the
same ae hereby repealed.

To regulate Sheriffs' and Coroners' sales in Barbour County.
Section 1. Be it enacted by the Senate and House of Reprc.
sentatires of the State of Alabama n General Assenbly contened,
That from and after the passage of this act, it shall be the du-
Sheritlo d. ty of the sheriff and coroner of the county of Harbour, in all
Vertigoesale cases, whereini they may be required by law, to expose to
sale land, or negroes, to advertise the same once a week, for
at least three weeks immediately preceding the day of sale, in
some newspaper published in the county in which said proper-
ty is to be sold.
Sec. 2. dnd be it further enacted, That in altcases of ad-
Printer's fee. vertisement as aforesaid, the said sheriff or coroner, as the
case may be, shall tax in the bill of costs, the sum of two dol-
lars, to pay for said advertisement ; which sun shall be paid
in the same manner, and at the same time as the other costs in
the case.
See. 3. .Ind be it further enacted, That all laws and parts
of laws, contravening the provisions of this act, be, and the
same are hereby repealed.

[No. 200.]              AN ACT
To levy a Special Tax in Talladega County.
Section 1. Be it enacted by, the Senate and House of Represen.
t4tives of the Stile of Alabama in General Assenbly convened,
That the Commissioners' Court of Talladinega county, be, and
they are hereby authorized to levy a special tax, in addition to
the county tax, not to exceed eight hundred dollars, to complete
the payment for building the court house in said county ; and
that the said Commissioners shall exercise their discretion in
collecting said sum of money, either in one or two years.
Approved, 29th January, 1845.
