per day, for each day they may be employed in the discharge of
their duties' under this act; and the clerk of the county court
shall be allowed the sum of two dollars for filing each claim and
recording thejudgenent ofthe court thereon; all of which expen-
ses shall be paid out of said fund, and the said county treasurer
shall be allowed the usual per centage for paying and receiving
the said money.

uporci s sioners are hereby authorized to issue to the purchaser or percha-
er.       sers of any part of said lands, a certificate of purchase of the said
land, or any portion thereof, which, when returned to the Secre-
tary of State's office, with a receipt or receipts from the county
treasurer, countersigned by the judge of the county court of
said county, showing the full payment of the same, shall entitle
the said purchaser or his assignee to a patent to said lot or portion
of land, and the Governor of the State is hereby required to cause
the same to issue.

missioners to carry into effect the provisions of this act more be-
neficially, they are hereby authorized to cause the said lands cast
of the Alabama, and the said land lying in the fork of the Alaba-
ma and Cahawba rivers, to be surveyed and laid off in lots or

AN ACT

Section 1. Be it enacted by the Senate and House of Represen-
tatives of the State of Alabama in General Assembly convened,

trat otyer- ty court of each and every county in this State, together with
two justices of the peace to he associated with him, or in case
there should be no julge of the counlty court, then any three jus-
tices of the peace, shall constitute a court for the trial of all slaves
and free persons of color, charged with any crime or misdemea-
nor of a higher grade than petit larceny.
The monde o  See. 2. And be it furither enacted, That whenever any slave
or   or free person of color, shall be brought before any justice of t e
peace, charged with the commission of any crime or misdemeanor
of a higher grade than petit larceny, if the justice, after exmnin-
ing the witnesses on the part of the prosecutor, shiafl believe there
exists any reasonable or probable grounds of the guilt lr crimi-
nality of such slave or free person of color, he shall immediately
-commit him or her to jail, and shall at the same time issue a
notice to the judge of the county court of his county, and also to
some justice of the peace, which notice shall be served by the
sheriff or some constable of the county,informing them o such
-commitment, and state the time and place of trial, which shall not
be less than ten nor more than fifteen days from the date of said
notice; and the said justice who shall make the commitment as
aforesaid, aid the judge of the county court, or if there be no
judge of the county courti two justices of the peace, summoned
