Re: Opinion No. 49-80
Dear Jackie:
You have requested further clarification of the construction
placed on Title 8 V.S.A. 54089(a) by Opinion No. 70-78 issued by
this office under date of May 24, 1978. I apologize for the delay
in response but it had been my understanding that the difficulty
had been resolved through a verbal communication.
The statutory provision cited provides:
(a) Any group health insurance policy
providing coverage on an expense incurred basis,
and any group service contract issued by a non-
profit corporation shall provide benefits for
mental health care, as an option and after the
payment of a premium, at least equal to the fol-
lowing minimum.
The minimum requirements follow. It is unnecessary to
recite them here since the question presented does not relate dir-
ectly to them.
The inquiry contained in your request involves only the con-
clusion numbered (3) in the earlier opinion which reads:
(3) Any mental health care benefits
provided must at least equal the stated minimum
which pertain.
